The Public Service Pensions Act 2013 (Commencement No. 3) Order 2014

The Treasury make the following Order in exercise of the powers conferred by section 41(2) and (3) of the Public Service Pensions Act 2013(1):

Citation and interpretation

1.—(1) This Order may be cited as the Public Service Pensions Act 2013 (Commencement No. 3) Order 2014.

(2) In this Order, “the Act” means the Public Service Pensions Act 2013.

Scheme regulation provisions: main commencement

2.—(1) 28th February 2014 is the day appointed for the coming into force of the provisions of the Act identified in paragraph (2) for all purposes.

(2) The provisions are—

(a)section 1 (schemes for persons in public service) and Schedule 1 (persons in public service: definitions);

(b)section 2 (responsible authority for schemes) and Schedule 2 (responsible authorities);

(c)section 3 (scheme regulations) and Schedule 3 (scope of scheme regulations: supplementary matters);

(d)section 8 (types of scheme);

(e)section 9(1), (2), (3), (4)(b), (5) and (6) (revaluation);

(f)section 19 (closure of existing injury and compensation schemes) and Schedule 6 (existing injury and compensation schemes);

(g)section 20 (final salary link) and Schedule 7 (final salary link);

(h)section 22 (procedure for protected elements);

(i)section 24 (other procedure);

(j)section 25 (extension of schemes);

(k)section 26 (non-scheme benefits); and

(l)section 37 (general interpretation).

Commencement for purpose of scheme regulations for teachers

3.—(1) 28th February 2014 is the day appointed for the coming into force of the provisions of the Act identified in paragraph (2) for the purpose of making scheme regulations to establish schemes for the payment of pensions and other benefits to or in respect of teachers.

(2) The provisions are—

(a)section 4 (scheme manager);

(b)section 5 (pension board);

(c)section 6 (pension board: information);

(d)section 7 (scheme advisory board);

(e)section 10 (pension age); and

(f)section 18 (restriction of existing pension schemes) and Schedule 5 (existing pension schemes).

Commencement of employer cost cap and benefit information provisions

4.  28th February 2014 is the day appointed for the coming into force of the following provisions of the Act—

(a)section 12(2), (3), (4), (5), (8) and (9) (employer cost cap), for the purposes of making Treasury directions under section 12(3) and Treasury regulations under section 12(5); and

(b)section 14 (information about benefits) for all remaining purposes.

Commencement of consequential amendments

5.  28th February 2014 is the day appointed for the coming into force of the following provisions of the Act—

(a)section 27 (minor and consequential amendments), for the purpose of introducing paragraphs 4 and 5 of Schedule 8 (amendments to the Pensions (Increase) Act 1971); and

(b)paragraphs 4 and 5 of Schedule 8, for all purposes.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force certain provisions of the Public Service Pensions Act 2013 (c.25). This is the third commencement order to be made under that Act.

Article 2 commences on 28th February 2014 sections 1 to 3 (establishment of new schemes); section 8 (types of scheme); section 9 (revaluation) except for the requirement to make an annual revaluation order; sections 19 and 20 (transitional); section 22 (procedure for protected elements); sections 24 to 26 (procedural and supplementary provisions); section 37 (general interpretation); and associated Schedules.

Article 3 commences on that date sections 4 to 7 (governance), section 10 (pension age), section 18 (restriction of existing pension schemes) and Schedule 5 (existing pension schemes) for the purpose of making scheme regulations for teachers.

Article 4 commences on that date specified subsections of section 12 (employer cost cap) for the purposes of making Treasury directions and Treasury regulations and section 14 (information about benefits) for all remaining purposes.

Article 5 commences on that date section 27 and paragraphs 4 and 5 of Schedule 8 (minor and consequential amendments) for the purposes of amendments to the Pensions (Increase) Act 1971.

This Order will have no effect on the costs of business and the voluntary sector. For that reason no impact assessment has been produced for it.
