The Secretary of State makes the following Order in exercise of the powers conferred by section 2 of the Digital Switchover (Disclosure of Information) Act 2007(1):
1. This Order may be cited as the Digital Switchover (Disclosure of Information) Act 2007 (Prescription of Information) (Amendment) Order 2011 and comes into force on 1 April 2011.
2. In article 3(4) of the Digital Switchover (Disclosure of Information) Act 2007 (Prescription of Information) Order 2007(2)—
(a)in the definition of “care home” for paragraph (b) substitute—
“(b)in relation to Scotland:
(i)means any establishment providing a care home service as defined by paragraph 2 of schedule 12 to the Public Services Reform (Scotland) Act 2010(3);
(ii)does not include any independent health care service as defined by section 10F of the National Health Service (Scotland) Act 1978(4);and”;
(b)in the definition of “independent hospital” for paragraph (b) substitute—
“(b)in relation to Scotland, means an independent healthcare service as defined in section 10F(1)(a) and (b) of the National Health Service (Scotland) Act 1978; and”.

This Order, made under the Digital Switchover (Disclosure of Information) Act 2007 (c. 8) (“the Act”), amends the Digital Switchover (Disclosure of Information) Act 2007 (Prescription of Information) Order 2007 (SI 2007/1768) (“the Prescription Order”).
The Prescription Order prescribes the descriptions of information that the Secretary of State may supply pursuant to the Act for the purposes of help to be provided to individuals under the Digital Switchover Help Scheme. This Order amends the Prescription Order’s definition of a ‘care home’ and an ‘independent hospital’ in relation to Scotland to take account of Scottish legislative changes.
