Further conviction in magistrates’ court after sentence deferred | rule 45.1 |
45.1. Where under section 1 of the Powers of Criminal Courts (Sentencing) Act 2000(1) a court has deferred passing sentence on an offender and before the expiration of the period of deferment he is convicted of any offence by a magistrates’ court, the court officer for the convicting court shall, if the court which deferred passing sentence on the earlier occasion was another magistrates’ court or the Crown Court, give notice of the conviction to the court officer for that court.
2000 c. 6; section 1 was substituted, together with sections 1A to 1D, for this section by section 278 of, and paragraph 1 of Schedule 23 to, the Criminal Justice Act 2003 (c. 44) and amended by article 3 of, and paragraph 14 of Schedule 1 to, S.I. 2008/912.
