The Secretary of State makes the following Order in exercise of the powers conferred by section 3(6) of the Terrorism Act 2000(1).
In accordance with section 3(6)(a) of that Act, the Secretary of State believes that the organisation referred to in article 2(1) of the following Order, being an organisation listed in Schedule 2 to that Act, is operating wholly or partly under a name that is not specified in that Schedule (whether as well as or instead of under the specified name).
1. This Order may be cited as the Proscribed Organisations (Name Change) Order 2009 and shall come into force on 2nd April 2009.
2. Jama’at ud Da’wa, being a name that is not specified in Schedule 2 to the Terrorism Act 2000, is to be treated as another name for Lashkar e Tayyaba, being an organisation listed in that Schedule(2).

Part 2 of the Terrorism Act 2000 makes provision about proscribed organisations (including the offences in respect of such organisation set out in sections 11 to 13). An organisation is proscribed if it is listed in Schedule 2 to that Act or operates under the same name as an organisation so listed (section 3(1)).
Section 3(6) of that Act (as inserted by section 22(2) of the Terrorism Act 2006) enables the Secretary of State, by order, to provide that a name that is not specified in Schedule 2 to that Act is to be treated as another name for an organisation that is listed in that Schedule. Accordingly, article 2 of this Order exercises this power to specify another name for the listed organisation referred to in that article.
2000 c.11; section 3(6) was inserted by section 22(2) of the Terrorism Act 2006 (c.11).
The relevant amendment was made by S.I. 2001/1261.
