1. These Regulations may be cited as the Cat and Dog Fur (Control of Import, Export and Placing on the Market) (Amendment) Regulations 2009 and shall come into force on 31st May 2009.
2.—(1) The Cat and Dog Fur (Control of Import, Export and Placing on the Market) Regulations 2008(3) are amended in accordance with the following regulations.
(2) In regulation 3(3), subparagraph (f), paragraph (ii), delete the words “under regulation 4”.
(3) At the end of the heading in regulation 4, insert the words “: England, Wales and Northern Ireland”.
(4) In regulation 4(1), after the words “enforcement authority”, insert the words “in England, Wales or Northern Ireland”.
(5) In regulation 4(5):
(a)after the semicolon in subparagraph (a), insert “and”; and
(b)delete the words “; and (c) in Scotland, to the Sheriff Court”.
(6) In regulation 5(3), delete the word “section” and substitute the word “regulation”.

These Regulations amend the Cat and Dog Fur (Control of Import, Export and Placing on the Market) Regulations 2008 to provide that regulation 4, which confers powers of forfeiture on enforcement agencies, applies only in England, Wales and Northern Ireland.
In Scotland, the Proceeds of Crime (Scotland) Act 1995(4) will apply following a conviction for breach of the Cat and Dog Fur (Control of Import, Export and Placing on the Market) Regulations 2008.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sector is foreseen.
