The Secretary of State for Communities and Local Government makes the following Order in exercise of the powers conferred by section 29(2) of the Local Government Act 1985(1) (“the Act”).

In accordance with section 29(3)(2) of the Act, she has had regard to the number of local government electors in the areas of those constituent councils which appoint members of the Tyne and Wear Fire and Rescue Authority(3).

In accordance with section 29(4) of the Act she has consulted with those constituent councils.

1.  This Order may be cited as the Tyne and Wear Fire and Rescue Authority (Increase in Number of Members) Order 2008 and shall come into force on 1st May 2008.

2.  In the table in Part 5 of Schedule 10 to the Local Government Act 1985, in the entry relating to North Tyneside in the column headed “Number of members of fire and civil defence authority”, for “2” substitute “3”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends Part 5 of Schedule 10 to the Local Government Act 1985 so as to increase from 2 to 3 the number of members which North Tyneside Metropolitan District Council may appoint to the Tyne and Wear Fire and Rescue Authority. As a consequence, the total number of members of that Authority increases from 15 to 16.

A full regulatory impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

Section 29(3) was amended by the Police and Magistrates’ Courts Act 1994 (c.29), Sch 9 Part 1.

The name of the Authority was changed from the Tyne and Wear Fire and Civil Defence Authority to the Tyne and Wear Fire and Rescue Authority by the Civil Contingencies Act 2004 (c.36), Sch 2 para 10.
