The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1) and now vested in her(2).

1.  This Order may be cited as the A446 Trunk Road (Bassetts Pole, Staffordshire to M6 Junction 4, Coleshill, Warwickshire) (Detrunking) Order 2007 and shall come into force on 28th January 2008.

2.  In this Order—

(i)all measurements of distance are measured along the route of the relevant highway;

(ii)“the plan” means the folio numbered HA 10/OD/487 consisting of 1 sheet and marked “The A446 Trunk Road (Bassetts Pole, Staffordshire to M6 Junction 4, Coleshill, Warwickshire) (Detrunking) Order 2007” signed by the authority of the Secretary of State for Transport and deposited at the ODPM–DfT Records Management Branch, Ashdown House, St Leonards on Sea, Hastings, East Sussex, TN37 7GA;

(iii)“principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

(iv)“the trunk road” means the A446 Trunk Road.

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Order comes into force.

SCHEDULELENGTHS OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is situated:

(i)between the southern boundary of its roundabout junction with the A453 and A38 at Bassetts Pole, excluding the circulatory carriageway of that roundabout (marked “A” on the plan) and the County Boundary of Staffordshire and Warwickshire at Bassetts Pole (marked “B” on the plan), a distance of approximately 30 m, all in the County of Staffordshire;

(ii)between the County Boundary of Staffordshire and Warwickshire at Bassetts Pole (marked “B” on the plan), and the northern boundary of its roundabout junction with the M42 Motorway and Kingsbury Road at Dunton, excluding the circulatory carriageway of the roundabout (marked “C” on the plan), a distance of approximately 7.6 km, all in the County of Warwickshire;

(iii)between the southern boundary of its roundabout junction with the M42 Motorway and Kingsbury Road at Dunton, excluding the circulatory carriageway of that roundabout (marked “D” on the plan), and the northern boundary of its roundabout junction with the M6 Motorway junction with the M6 Motorway at Coleshill, excluding the circulatory carriageway of that roundabout (marked “E” on the plan), a distance of approximately 7.8 km, all in the County of Warwickshire.

The three lengths are shown in broad black dashes on the plan numbered HA 10/OD/487 marked “The A446 Trunk Road (Bassetts Pole, Staffordshire to M6 Junction 4, Coleshill, Warwickshire) (Detrunking) Order 2007” signed by authority of the Secretary of State for Transport, ODPM–DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
