The Secretary of State makes the following Order in exercise of the powers conferred by section 85(3A)(b)(1) of the Education Act 2002(2):

Citation, commencement, interpretation and application

1.—(1) This Order may be cited as the Education (National Curriculum) (Science at Key Stage 4) (England) Order 2007 and comes into force on 1st September 2007.

(2) In this Order, “GCSE” means General Certificate of Secondary Education.

(3) This Order applies to maintained schools in England.

Specification of sets of qualifications

2.  The following are specified as sets of qualifications for the purposes of section 85(3A)(b) of the Education Act 2002—

(a)Science GCSE and Additional Science GCSE;

(b)Physics GCSE, Chemistry GCSE and Biology GCSE.

EXPLANATORY NOTE

(This note is not part of the Order)

Section 85(3A) of the Education Act 2002 entitles a pupil in the fourth key stage (if he so elects) to follow a course of study in science which leads to a qualification or set of qualifications as the governing body may choose from among those approved under section 98 of the Learning and Skills Act 2000 and specified by the Secretary of State. Section 85(3A)(b) enables the Secretary of State to specify the qualification or set of qualifications by order for the purposes of that subsection. This Order specifies two sets of qualifications for those purposes. The first set of qualifications entitles a pupil to take a course of study which leads to two separate GCSE qualifications, in Science and Additional Science. The second set of qualifications is three separate GCSE qualifications in the sciences of Physics, Chemistry and Biology (often referred to as “Triple Science”).

Section 85(3A) was inserted by section 74(4)(b) of the Education and Inspections Act 2006, c. 40. Section 74(4) was commenced by article 5(k) of S.I. 2007/935, and has effect until section 74(1) is commenced, which will substitute a new section 85 of the Education Act 2002. By section 74(5) of the 2006 Act an order made by virtue of subsection (4) under section 85(3A) of the 2002 Act has effect, following commencement of the new section 85, as if made under subsection (5) of the new section 85.
