The Exclusion Order (Monitoring of Offenders) Order 2005

The Secretary of State, in exercise of the powers conferred upon him by sections 40A(6) and 160(5)(a) of the Powers of Criminal Courts (Sentencing) Act 2000(1) hereby make the following Order:

1.—(1) This Order may be cited as the Exclusion Order (Monitoring of Offenders) Order 2005 and shall come into force on 1st April 2005.

(2) In this Order “police area” has the meaning given by section 1 of the Police Act 1996(2).

2.  The description of person responsible for monitoring the whereabouts of an offender subject to an exclusion order for the purposes of section 40A(6) (exclusion orders) of the Powers of Criminal Courts (Sentencing) Act 2000—

(a)in relation to such a condition imposed on an offender residing in a police area specified in Schedule 1 to this Order, is one employed by Premier Monitoring Services, PO Box 45, Norwich, NR3 1BF to monitor offenders; and

(b)in relation to such a condition imposed on an offender residing in a police area specified in Schedule 2 to this Order, is one employed by Securicor Justice Services, Sutton Park, 15 Carshalton Road, Sutton, Surrey, SML 4LD to monitor offenders.

3.  The Exclusion Order (Monitoring of Offenders) Order 2004(3) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order makes provision for the different persons responsible for the electronic monitoring of offenders subject to an exclusion order imposed under section 40A of the Powers of Criminal Courts (Sentencing) Act 2005. It revokes the Exclusion Order (Monitoring of Offenders) Order 2004 (S.I. 2004/2172) in order to reflect changes to the areas covered by the monitoring providers.

2000 c. 6. Section 40A was inserted by section 46 of the Criminal Justice and Court Services Act 2000 (c. 43), and is amended by paragraph 100 of Schedule 32 to the Criminal Justice Act 2003 (c. 44). Section 160(5) was substituted by paragraph 196(d) of Schedule 7 to the Criminal Justice and Court Services Act 2000.
