In exercise of the powers conferred on the Secretary of State by sections 187(5) and (6), 231 (2) and 232(5) of the Education Reform Act 1988(1) the Secretary of State for Education and Skills hereby makes the following Order:
1. This Order may be cited as the Education (London Residuary Body) (Property Transfer) (Amendment) Order 2005 and shall come into force on 15th July 2005.
2.—(1) The Education (London Residuary Body) (Property Transfer) (No 4) Order 1991(2) shall be amended as follows:
(2) In article 4(4) for “1st January 1995” there shall be substituted “1st April 2007”.

This Order amends the Education (London Residuary Body) (Property Transfer) (No 4) Order 1991.
The 1991 Order (as amended by S.I. 1994/3078, article 2 and S.I. 1998/1239, article 1) transferred land described as the former New River School, Clissold Road, N16 to the Council of the London Borough of Hackney. The transfer was subject to the condition that by 1st January 1995 the land was to be brought into use wholly or mainly for the purposes of the transferee council’s functions as the local education authority for the area. The Order further provided that if the land were not so brought into use it should be disposed of and the proceeds of sale (after deductions) divided between the Councils of the inner London boroughs and the Common Council of the City of London.
The Order amends the condition by extending the date by which the Council of the London Borough of Hackney should fulfil the condition to 1st April 2007.
S.I. 1991/2778 to which there are amendments not relevant to this Order.
