The Secretary of State, in exercise of the powers conferred upon him by section 4(1)(a) of the Local Government Act 1999(1) (having regard to the definition in section 1(1)(d)), and having consulted, in accordance with section 4(3) of that Act, persons appearing to him to represent police authorities and such other persons as he thought fit, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Police Authorities (Best Value) Performance Indicators Order 2004 and shall come into force on 1st April 2004.

Performance indicators

2.  The performance indicators by reference to which the performance of each police authority in England and Wales can be measured in exercising their functions are hereby specified in—

(a) Schedule 1 (citizen focus);

(b) Schedule 2 (reducing crime);

(c) Schedule 3 (investigating crime);

(d) Schedule 4 (promoting public safety); and

(e) Schedule 5 (resource use).

Amendment of the Local Government (Best Value) Performance Indicators and Performance Standards Order 2003

3.  For article 2 of the Local Government (Best Value) Performance Indicators and Performance Standards Order 2003(2) there is substituted the following article—

“Application

2.   This Order applies—

(a) in relation to England, to all best value authorities except authorities falling within section 1(1)(d) of the Act (police authorities); and

(b) in relation to Wales, only to authorities falling within section 1(1)(e) of the Act (fire authorities).”

Revocations

4.—(1) The following Orders are hereby revoked—

(a) the Police Authorities (Best Value) Performance Indicators Order 2003(3); and

(b) the Police Authorities (Best Value) Performance Indicators (Amendment) Order 2003(4).

Article 2

SCHEDULE 1 CITIZEN FOCUS

Indicator number	Description of Indicator
1	Satisfaction of victims of domestic burglary, violent crime, vehicle crime and road traffic collisions with respect to— (a) making contact with the police; (b) action taken by the police; (c) being kept informed of progress; (d) their treatment by staff; and (e) the overall service provided.
2	(a) Using the British Crime Survey, the percentage of people who think their local police do a good job.
3	(a) Satisfaction of victims of racist incidents with respect to the overall service provided. (b) From 1(e), comparison of satisfaction for white users and users from visible minority ethnic groups with respect to the overall service provided. (c) Percentage of PACE stop/searches which lead to arrest by ethnicity of the person stopped. (d) Comparison of percentage detected of violence against the person offences by ethnicity of the victim.

Article 2

SCHEDULE 2 REDUCING CRIME

Indicator number	Description of Indicator
4	Using the British Crime Survey— (a) the risk of personal crime; and (b) the risk of household crime.
5	(a) Domestic burglaries per 1,000 households. (b) Violent crime per 1,000 population. (c) Robberies per 1,000 population. (d) Vehicle crime per 1,000 population. (e) Life threatening crime and gun crime per 1,000 population.

SCHEDULE 3 INVESTIGATING CRIME

Indicator number	Description of Indicator
6	(a) Number of notifiable/recorded offences resulting in conviction, caution or taken into consideration at court. (b) Percentage of notifiable/recorded offences resulting in conviction, caution or taken into consideration at court. (c) Number of Class A drug supply offences brought to justice per 10,000 population; of these the percentage each for cocaine and heroin supply.
7	(a) Percentage of notifiable/recorded offences resulting in charge, summons, caution or taken into consideration at court. (b) Percentage detected of domestic burglaries. (c) Percentage detected of violent crime. (d) Percentage detected of robberies. (e) Percentage detected of vehicle crime.
8	(a) Percentage of domestic violence incidents with a power of arrest where an arrest was made related to the incident. (b) Of 8(a), the percentage of partner-on-partner violence.

Article 2

SCHEDULE 4 PROMOTING PUBLIC SAFETY

Indicator number	Description of Indicator
9	(a) Road traffic collisions resulting in death or serious personal injury per 100 million vehicle kilometres travelled.
10	Using the British Crime Survey— (a) fear of crime; and (b) feelings of public safety.

SCHEDULE 5 RESOURCE USE

Indicator number	Description of Indicator
11	(a) Proportion of police officer time available for frontline policing.
12	(a) Proportion of police recruits from minority ethnic groups compared to the proportion of people from minority ethnic groups in the economically active population. (b) Ratio of officers from minority ethnic groups resigning to all officer resignations. (c) Percentage of female police officers compared to overall force strength.
13	(a) Number of working hours lost due to sickness by police officers. (b) Number of working hours lost due to sickness by police staff.

Explanatory Note

(This note is not part of the Order)

Part I of the Local Government Act 1999 imposes requirements on police authorities, and other authorities, to secure continuous improvement in the way in which their functions are exercised, having regard to a combination of economy, efficiency and effectiveness. Section 4(1) of that Act confers a power of the Secretary of State to specify by Order best value performance indicators applicable to local authorities, police authorities and other authorities.

Article 2 of this Order specifies that the performance indicators set out in Schedules 1 to 5 of this Order are to be the indicators by which a police authority’s performance can be measured.

Article 3 of this Order removes police authorities in England and Wales from the list of best value authorities to which the Local Government (Best Value) Performance Indicators and Performance Standards Order 2003 (S.I. 2003/530) applies.

Article 4 of this Order revokes the Police Authorities (Best Value) Performance Indicators Order 2003 and the Police Authorities (Best Value) Performance Indicators (Amendment) Order 2003.
