The Secretary of State for Health, in exercise of the powers conferred upon him by sections 55(3)(g), 118(1), (4) and (5) of the Care Standards Act 2000(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:—
1.—(1) These Regulations may be cited as the General Social Care Council (Description of Persons to be Treated as Social Care Workers) Regulations 2004 and shall come into force on 1st April 2004.
(2) In these Regulations, “the Act” means the Care Standards Act 2000.
(3) These Regulations apply to England only.
2. For the purposes of section 55 of the Act (interpretation), a person participating in a course approved by the General Social Care Council(2) under section 63 of the Act for persons wishing to become social workers, shall be treated as a social care worker.

These Regulations, which apply to England only, are made under section 55(3)(g) of the Care Standards Act 2000 (“the Act”) and provide that persons who are undertaking a course which has been approved by the General Social Care Council under section 63 of the Act are to be treated as social care workers for the purposes of section 55 of the Act.
The General Social Care Council was established by section 54(1)(a) of the Care Standards Act 2000.
