The Secretary of State for Defence, (“the Secretary of State”), in exercise of the powers conferred upon him by section 1(2) of the Protection of Military Remains Act 1986(1) hereby makes the following Order:

(2) In this Order any reference to a point is a reference to a point given by co-ordinates based on the World Geodetic System 1984.
2. Article 3(c)(ii) of the Protection of Military Remains Act 1986 (Designation of Vessels and Controlled Sites) Order 2002 (2) shall be amended by substituting the word “East”, which appears at the end of the co-ordinates, for the word “West”.

Parliamentary Under Secretary of State for Defence
(This note is not part of the Order)
This Order corrects an error in the Protection of Military Remains Act 1986 (Designation of Vessels and Controlled Sites) Order 2002, article 3(c)(ii) of which gives the wrong co-ordinates for an area that it designates as a controlled site. Article 3(c)(ii) gives the co-ordinates of the area to be designated as lying at longitude East. This Order corrects that co-ordinate to show that the area designated as a controlled site lies at longitude West.
This Order is being made available free of charge to all those who can show that they have already bought or who subsequently buy the Protection of Military Remains Act 1986 (Designation of Vessels and Controlled Sites) Order 2002.
1986 c. 35. The power to designate any land as, or as part of, a controlled site is exercisable in relation to Crown land as it is exercisable in relation to other land: see section 1(7). The terms “controlled site” and “remains” are defined in section 9(1). Section 9(2) states when a vessel is to be regarded as having been in military service.
