The Secretary of State for Health, in exercise of the powers conferred on him by sections 8(1) to (4) and (6) and 126(3), (4) and (5) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, and after consultation with the Council on Tribunals in accordance with section 8 of the Tribunals and Inquiries Act 1992(2), hereby makes the following Order:
1977 c. 49; section 8 was substituted by the Health Authorities Act 1995 (c. 17), section 1(1), and amended by the Health Act 1999 (c. 8) (“the 1999 Act”), Schedule 4, paragraph 5; section 126(3) and (4) was amended by the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”), section 65(2), by the National Health Service (Primary Care) Act 1997 (c. 46), Schedule 2, paragraph 27, and by the 1999 Act, Schedule 4, paragraph 37(6); section 126(5) was added by the 1990 Act, section 65(2). The functions of the Secretary of State under these provisions are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of, and the entry for the Act in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672, as amended by section 66(5) of the 1999 Act and by section 69 of the Health and Social Care Act 2001 (c. 15).
