In exercise of the powers conferred on the Secretary of State by sections 29(5), 408, 537 and 569(4) and (5) of the Education Act 1996(1), sections 92(2) and 138(1) of the School Standards and Framework Act 1998, and of all other powers enabling him in that behalf, the Secretary of State for Education and Skills hereby makes the following Regulations:
1996 c. 56; by virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672), the powers conferred by these provisions are exercisable by the Secretary of State only in relation to England. For the definition of “regulations” see section 579(1).
Section 92 of the 1998 Act was substituted by paragraph 7 of Schedule 4 to the 2002 Act; by virtue of section 211(1) of the 2002 Act, the powers conferred by section 92 as substituted are exercisable by the Secretary of State only in relation to England.
