Whereas the Secretary of State has, in accordance with section 11(5) of the Consumer Protection Act 1987(1), consulted such organisations as appear to her to be representative of interests substantially affected by these Regulations, such other persons as she considers appropriate and the Health and Safety Commission;

Now, therefore, the Secretary of State, in exercise of the powers conferred on her by section 11 of the said Act, hereby makes the following Regulations—

1.  These Regulations may be cited as the Dangerous Substances and Preparations (Safety) (Consolidation) (Amendment No. 2) Regulations 2002 and shall come into force on 18 January 2003.

2.  Schedule 2 to the Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994(2) is hereby amended as follows—

(a)under the heading “Carcinogenic substances of Category 1”—

(i)after the entry relating to salts of biphenyl-4-ylamine; salts of xenylamine; salts of 4-aminobiphenyl in the first column, there shall be inserted the entry set out in Part 1 of the Schedule hereto;

(ii)after the entry relating to erionite in the first column, there shall be inserted the entry set out in Part 2 of the Schedule hereto; and

(b)under the heading “Carcinogenic substances of Category 2”, after the entry relating to hydrazine bis (3-carboxy-4-hydroxybenzensulfonate) in the first column, there shall be inserted the entry set out in Part 3 of the Schedule hereto.

Explanatory Note

(This note is not part of the Regulations)

These Regulations implement European Parliament and Council Directive 2001/41/EC (O.J. No. L194, 18.07.01, p.36), which amended for the 21st time Council Directive 76/769/EEC (O.J. No. L262, 27.9.76, p.201) on the approximation of the laws, regulations and administrative provisions of the Member States relating to the restrictions on the marketing and use of certain dangerous substances and preparations.

These Regulations amend the Dangerous Substances and Preparations (Safety) (Consolidation) Regulations 1994 (S.I. 1994/2844; “the Principal Regulations”). The Principal Regulations prohibit the supply to the general public of the substances listed in Schedule 2 to those Regulations.

A substance specified in Schedule 2 to the Principal Regulations or a preparation containing such a substance is required to be classified and labelled in accordance with regulation 8(4) of the Chemicals (Hazard Information and Packaging for Supply) Regulations 2002 (S.I. 2002/1689). The list of substances is derived from the Annex to Directive 76/769/EEC. It is a list of carcinogenic and mutagenic substances and certain substances toxic to reproduction. These Regulations update the list to include the amendments made by Directive 2001/41/EC.
