The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred on him by sections 140(4) and 143(1) and (2) of, and paragraphs 4 and 6 of Schedule 8 to, the Local Government Finance Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Non-Domestic Rating Contributions (England) (Amendment) Regulations 1999 and shall come into force on 31st December 1999.

Amendment of the 1992 Regulations

2.  Schedules 1 and 2 to the Non-Domestic Rating Contributions (England) Regulations 1992(2) are amended as follows.

Rules for calculations of contributions

3.—(1) In relation to financial years beginning on or after 1st April 2000, in Schedule 1—

(a)in paragraph 1(4), for “1999” there is substituted “2000”;

(b)in paragraph 4(4), for “1999 is £82,506,000” there is substituted “2000 is £83,476,000”;

(c)for Part II there is substituted—

Explanatory Note

(This note is not part of the Regulations)

Under Part II of Schedule 8 to the Local Government Finance Act 1988, billing authorities are required to pay amounts (called non-domestic rating contributions) to the Secretary of State. Payments in respect of a provisional amount of the contributions are made during the financial year, final calculations and any adjustments of payments being made after the year ends.

These Regulations amend the rules for calculation of contributions contained in the Non-Domestic Rating Contributions (England) Regulations 1992, with effect from 1st April 2000.

Regulations 3 and 4 alter certain figures used in the calculation of contributions and provisional amounts. Regulation 5 makes special provision for the calculation in relation to Sunderland City Council, in respect of the cessation of enterprise zones.

These powers are devolved, in relation to Wales, to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672); see the reference to the Local Government Finance Act 1988 in Schedule 1.
