The Secretary of State, being satisfied that it is necessary, by reason of the coming into force of provisions of the Environment Act 1995(1), to make an additional consequential amendment of the public general enactment specified in these Regulations, in exercise of his powers under section 120(1) of the Environment Act 1995, hereby makes the following Regulations:
1. These Regulations may be cited as the Environment Act 1995 (Consequential Amendment) Regulations 1999 and shall come into force on 6th May 1999.
2. In subsection (3)(c) of section 140 (other controls on substances, articles or waste) of the Environmental Protection Act 1990(2) for “section 17 above” there shall be substituted “section 108 of the Environment Act 1995”.

These Regulations make an additional amendment to the Environmental Protection Act 1990 (“the 1990 Act”) as a result of the coming into force of provisions of the Environment Act 1995 which repeal section 17 (powers of entry) of the 1990 Act.
Regulation 2 amends subsection (3)(c) of section 140 of the 1990 Act, which confers power to make regulations, by substituting for the reference to section 17 of that Act, a reference to section 108 (powers of entry) of the Environment Act 1995.
1995 c. 25; paragraph 55 of Schedule 22 and the relevant repeal in Schedule 24, by virtue of which section 17 of the Environmental Protection Act 1990 ceased to have effect, came into force on 1st April 1996 (S.I. 1996/186, article 3).
