Citation, commencement and interpretation

1.—(1) This Order may be cited as the Regional Health Authorities (Transfer of Trust Property) Order 1996 and shall come into force on 1st April 1996.

(2) In this Order, except where the context otherwise requires—

(a)“trust property” means, as respects any Regional Health Authority, any property held on trust by that Authority immediately before 1st April 1996, but does not include any such property which is transferred on that date by virtue of section 92 of the National Health Service Act 1977(1); and

(b)any reference to a numbered Schedule is a reference to the Schedule to this Order which bears that number.

Transfer of trust property

2.—(1) Trust property held by Regional Health Authorities shall be transferred on 1st April 1996 in accordance with the following paragraphs of this article.

(2) As respects the Anglia and Oxford Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 1, the trust property specified in column (2) in that Part in relation to that body; and

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the trust property known as the General Fund as is specified in column (2) in that Part in relation to that body.

(3) As respects the Northern and Yorkshire Regional Health Authority there is transferred to the Leeds Health Authority the trust property known as the Yorkshire Cancer Organisation Fund.

(4) As respects the North Thames Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 2, the trust property specified in column (2) in that Part in relation to that body; and

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the remainder of the trust property known as the General Fund as is specified in column (2) in that Part in relation to that body.

(5) As respects the North West Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 3, the trust property specified in column (2) in that Part in relation to that body;

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the trust property known as the Mersey General Purposes Fund as is specified in column (2) in that Part in relation to that body; and

(c)to each of the bodies specified in column (1) in Part III of that Schedule, such proportion of the trust property known as the North Western General Purposes Fund as is specified in column (2) in that Part in relation to that body.

(6) As respects the South Thames Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 4, the trust property specified in column (2) of that Part in relation to that body;

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the remainder of the trust property known as the Former South West Thames Regional Health Authority General Fund as is specified in column (2) in that Part in relation to that body; and

(c)to each of the bodies specified in column (1) in Part III of that Schedule, such proportion of the remainder of the trust property known as the Former South East Thames Regional Health Authority General Fund as is specified in column (2) in that Part in relation to that body.

(7) As respects the South and West Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 5, the trust property specified in column (2) in that Part in relation to that body; and

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the trust property known as the General Fund as is specified in column (2) in that Part in relation to that body.

(8) As respects the Trent Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 6, the trust property specified in column (2) in that Part in relation to that body; and

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the remainder of the trust property known as the Section 93 Fund as is specified in column (2) in that Part in relation to that body.

(9) As respects the West Midlands Regional Health Authority there is transferred—

(a)to each of the bodies specified in column (1) in Part I of Schedule 7, the trust property specified in column (2) in that Part in relation to that body; and

(b)to each of the bodies specified in column (1) in Part II of that Schedule, such proportion of the trust property known as the General Endowment Fund as is specified in column (2) in that Part in relation to that body.

(10) As respects each Regional Health Authority specified in column (1) of Schedule 8 there is transferred to the body specified in column (2) of that Schedule in relation to that Regional Health Authority any trust property which is not transferred to another body by virtue of any other paragraph of this article.

(11) In—

(a)sub-paragraph (b) of paragraph (4) above;

(b)sub-paragraphs (b) and (c) of paragraph (6) above; and

(c)sub-paragraph (b) of paragraph (8) above,

  • “the remainder” means, in relation to any fund referred to in any of those sub-paragraphs, such amount of that fund as remains after the deduction from it of any amount which falls to be transferred from that fund by virtue of sub-paragraph (a) of that paragraph.

Supplemental provision

3.  Any body to which trust property is transferred by virtue of article 2(10) of this Order may execute such instrument or other document as may be necessary for the purpose of giving effect to any provision of this Order and it relates to that property.
