INDUSTRIAL TRIBUNALS

The Industrial Tribunals Act 1996 (Commencement) Order 1996

The Secretary of State, in exercise of the powers conferred on him by paragraphs 7(1), (2), (7) and (8) of Part II of Schedule 2 to the Industrial Tribunals Act 1996(1), hereby makes the following Order:

Citation

1.  This Order may be cited as the Industrial Tribunals Act 1996 (Commencement) Order 1996.

Commencement

2.  The day appointed as that from which the Industrial Tribunals Act 1996 has effect with the inclusion of sections 12(3) to (6) and 32(3) to (6) of the Act is the day after the day on which this Order is made.

Explanatory Note

(This note is not part of the Order)

This Order commences the sections of the Industrial Tribunals Act 1996 (“the 1996 Act”) referred to in Article 2 on the day after the Order is made.

The provisions in question relate to offences for breaching orders made by industrial tribunals and the Employment Appeal Tribunal restricting publicity in disability discrimination cases, and were contained in sections 62 and 63 of the Disability Discrimination Act 1995 (c. 50) (“the 1995 Act”) before being consolidated in sections 12 and 32 of the 1996 Act. The 1996 Act came into force on 22 August 1996 repealing the relevant provisions of sections 62 and 63 of the 1995 Act before they had been commenced.

Paragraphs 7(1), (2), (7) and (8) of Part II of Schedule 2 to the 1996 Act have the effect that in these circumstances the Act has effect with the omission of the provisions in question until such day as the Secretary of State may appoint by order.
