NORTHERN IRELAND

The Northern Ireland (Emergency and Prevention of Terrorism Provisions) (Continuance) Order 1996

Whereas a draft of this Order has been approved by resolution of each House of Parliament;

Now, therefore, in exercise of the powers conferred upon me by section 69(3)(a) of the Northern Ireland (Emergency Provisions) Act 1991(1) and section 27(11)(a) of the Prevention of Terrorism (Temporary Provisions) Act 1989(2), I hereby make the following Order:

1.  This Order may be cited as the Northern Ireland (Emergency and Prevention of Terrorism Provisions) (Continuance) Order 1996 and shall come into force on 16th June 1996.

2.  In this Order—

(a)“the temporary provisions of the 1991 Act” means parts I to VIII of the Northern Ireland (Emergency Provisions) Act 1991 except—

(i)section 7, Part III of Schedule 1 and, so far as they relate to offences which are scheduled offences by virtue of that Part, sections 3, 9 and 10;

(ii)sections 63 and 64; and

(iii)paragraph 20 of Schedule 4; and

(b)“the 1989 Act provisions” means the provisions referred to in section 27(11) of the Prevention of Terrorism (Temporary Provisions) Act 1989, that is to say Parts III and V of that Act so far as they have effect in Northern Ireland and relate to proscribed organisations for the purposes of section 28 of the Northern Ireland (Emergency Provisions) Act 1991 or offences or orders under that section.

3.  The temporary provisions of the 1991 Act except section 34 and Schedule 3, and the 1989 Act provisions, shall continue in force for the period beginning with 16th June 1996 and ending with 26th August 1996.

Explanatory Note

(This note is not part of the Order)

This Order continues in force, with exceptions, the temporary provisions of the Northern Ireland (Emergency Provisions) Act 1991 for the period from 16th June 1996 to 26th August 1996, when the Act is repealed altogether by virtue of section 69(9). The exceptions are section 34 and Schedule 3, which relate to the detention of terrorists and are not in force.

This Order also continues in force for the same period the provisions referred to in section 27(11) of the Prevention of Terrorism (Temporary Provisions) Act 1989. Those provisions are treated as part of the 1991 Act for the purposes of section 69(9), and are therefore repealed on the same day as the 1991 Act.
