ROAD TRAFFIC

The Road Traffic (Special Parking Areas) (London Boroughs of Bromley, Hammersmith and Fulham and Lewisham) (Amendment) Order 1994

Whereas the councils of the London boroughs of Bromley, Hammersmith and Fulham and Lewisham have each applied to the Secretary of State for an order to be made under section 76 of the Road Traffic Act 1991(1) amending an order made by him under that section, and the Secretary of State has consulted the Commissioner of Police of the Metropolis in accordance with section 76(2) of that Act:

NOW, the Secretary of State for Transport, in exercise of the powers conferred by section 76(1) and section 77(6) of the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Road Traffic (Special Parking Areas) (London Boroughs of Bromley, Hammersmith and Fulham and Lewisham) (Amendment) Order 1994 and shall come into force on 1st April 1994.

Interpretation

2.  In this Order—

“the 1984 Act” means the Road Traffic Regulation Act 1984(2);

“the 1991 Act” means the Road Traffic Act 1991;

“the 1993 Order” means the Road Traffic (Special Parking Areas) (London Boroughs of Bromley, Hammersmith and Fulham and Lewisham) (London Borough of Wandsworth) (Amendment) Order 1993(3); and

a reference to a Schedule followed by a number is a reference to the Schedule to this Order bearing that number.

Exclusions from special parking areas

3.—(1) Those areas in the London borough of Bromley referred to in Schedule 1 shall cease to form part of the special parking area designated by article 4(1)(a) of the 1993 Order.

(2) Those areas in the London borough of Hammersmith and Fulham referred to in Schedule 2 shall cease to form part of the special parking area designated by article 4(1)(b) of the 1993 Order.

(3) Those areas in the London borough of Lewisham referred to in Schedule 3 shall cease to form part of the special parking area designated by article 4(1)(c) of the 1993 Order.

(4) The modifications of the 1984 and 1991 Acts contained in articles 5 and 6 of the 1993 Order shall cease to have effect in relation to the areas referred to in Schedules 1, 2 and 3.

Article 3(1)

SCHEDULE 1AREAS IN THE LONDON BOROUGH OF BROMLEY CEASING TO FORM PART OF THE SPECIAL PARKING AREA

1.  The areas to be transferred from the London borough of Bromley to the county of Kent and the district of Sevenoaks and referred to in the table to article 3(1) of the Greater London, Kent and Surrey (County Boundaries) Order 1993(4).

2.  The areas to be transferred from the London borough of Bromley to the county of Surrey and the district of Tandridge and referred to in the table to article 4(1) of the Greater London, Kent and Surrey (County Boundaries) Order 1993.

3.  The areas to be transferred from the London borough of Bromley to the London borough of Croydon and referred to in the table to article 5(1) of the Greater London and Surrey (County and London Borough Boundaries) Order 1993(5).

4.  The areas to be transferred from the London borough of Bromley to the London borough of Croydon and referred to in article 3(1) of the Bromley, Croydon, Lambeth, Lewisham and Southwark (London Borough Boundaries) Order 1993(6).

5.  The areas to be transferred from the London borough of Bromley to the London borough of Greenwich and referred to in the table to article 3 of the Bromley and Greenwich (London Borough Boundaries) Order 1993(7).

Article 3(2)

SCHEDULE 2AREAS IN THE LONDON BOROUGH OF HAMMERSMITH AND FULHAM CEASING TO FORM PART OF THE SPECIAL PARKING AREA

The areas to be transferred from the London borough of Hammersmith and Fulham to the London borough of Ealing and referred to in the table to article 3(2) of the Ealing, Hammersmith and Fulham, and Hounslow (London Borough Boundaries) Order 1993(8).

Article 3(3)

SCHEDULE 3AREAS IN THE LONDON BOROUGH OF LEWISHAMCEASING TO FORM PART OF THE SPECIAL PARKING AREA

1.  The areas to be transferred from the London borough of Lewisham to the London borough of Greenwich and referred to in the table to article 3(2) of the Greenwich and Lewisham (London Borough Boundaries) Order 1993(9).

2.  The areas to be transferred from the London borough of Lewisham to the London borough of Southwark and referred to in the table to article 3 of the Lewisham and Southwark (London Borough Boundaries) Order 1993(10).

Explanatory Note

(This note is not part of the Order)

The Road Traffic (Special Parking Areas) (London Boroughs of Bromley, Hammersmith and Fulham and Lewisham) (London Borough of Wandsworth) (Amendment) Order 1993 designated the whole of the London boroughs of Bromley, Hammersmith and Fulham and Lewisham (excluding the roads referred to in Schedules 2, 3 and 4 respectively) as special parking areas for the purposes of Part II of the Road Traffic Act 1991. It also made consequential modifications to the Road Traffic Regulation Act 1984 and to Part II of the 1991 Act. This Order excludes from the special parking areas so designated certain areas which, in consequence of local government boundary changes, will cease to form part of the London boroughs concerned and will be transferred to local government areas where a special parking area has not been designated. The areas concerned are described in the Schedules to this Order by reference to the relevant boundary change Orders. This Order also provides that the consequential modifications of the 1984 and 1991 Acts are to cease to apply to the transferred areas.
