The Road Traffic Act 1991 (Commencement No. 6) Order 1993

The Secretary of State, in exercise of the powers conferred on him by section 84 of the Road Traffic Act 1991((1)) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Road Traffic Act 1991 (Commencement No. 6) Order 1993.

(2) In this Order “the Act” means the Road Traffic Act 1991; and section 331(3) of the Criminal Procedure (Scotland) Act 1975((2)) shall apply for the purposes of this Order as it applies for the purposes of that section.

Commencement

2.  The provisions of the Act which are specified in column 1 of the Schedule to this Order shall, insofar as they are not then in force, come into force on 1st April 1993, but, when a particular purpose is specified in column 2 of that Schedule in relation to any such provision, that provision shall come into force on that day only for that purpose.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 1st April 1993 provisions of the Road Traffic Act 1991 which relate to the proof of the identity of the driver of a vehicle in certain criminal proceedings in Scotland. The new provisions will apply only to summary criminal proceedings brought on or after 1st April 1993.
