INTERNATIONAL IMMUNITIES AND PRIVILEGES

The Vienna Document 1992 (Privileges and Immunities) Order 1992

The Queen’s Most Excellent Majesty in Council

Whereas a draft of this Order has been laid before Parliament in accordance with section 1(2) of the Arms Control and Disarmament (Privileges and Immunities) Act 1988(1) and has been approved by resolution of each House of Parliament:

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1(2) of the said Act 1988 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  —:

(1) This Order may be cited as the Vienna Document 1992 (Privileges and Immunities) Order 1992. It shall come into force forthwith.

(2) In this Order “the Vienna Document 1992” means the Vienna Document 1992 of the Negotiations on Confidence-and-Security-Building Measures convened in accordance with the relevant provisions of the Concluding Document of the Vienna Meeting of the Conference on Security and Co-operation in Europe(2).

2.  Persons designated by a State other than the United Kingdom as observers, inpsectors or evaluators under the Vienna Document 1992 shall enjoy, during their mission, the like privileges and immunities as are accorded to or in respect of diplomatic agents by the Diplomatic Privileges Act 1964(3).

3.  Persons designated by a State other than the United Kingdom as auxiliary personnel for an inspection or evaluation carried out under the Vienna Document 1992 and performing administrative and technical services, or domestic services, shall enjoy, during their mission, the like privileges and immunities, as are accorded to or in respect of members of the administrative and technical staff or, as the case may be, of the service staff of a mission by the Diplomatic Privileges Act 1964.

4.  The Vienna Document (Privileges and Immunities) Order 1991(4) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order confers privileges and immunities on observers, inspectors and evaluators, and auxiliary personnel, as required for giving effect in the United Kingdom to paragraphs 58, 97 and 130 of the Vienna Document 1992 of the Negotiations on Conference-and-Security-Building Measures convened in accordance with the relevant provisions of the Concluding Document of the Vienna Meeting of the Conference on Security and Co-operation in Europe (Cm. 1972).
