The Education (National Curriculum) (Exceptions in History and Geography at Key Stage 4) Regulations 1992

Whereas the National Curriculum Council, after due consultation, submitted to the Secretary of State and published its report on a proposal to make these Regulations which he had referred to it, in accordance with section 20(2) to (4) of the Education Reform Act 1988(1);

  • And whereas the Secretary of State had given notice of the said proposal to the Curriculum Council for Wales and to all other persons with whom consultation appeared to him desirable, in accordance with section 21(2) of the said Act;

  • And whereas the Secretary of State, in accordance with subsection (5) of the said section 20 and subsection (3) of the said section 21, duly published a draft of these Regulations and sent copies of it to the said Councils and to each of the persons consulted by them, and allowed a period of not less than one month for the submission of evidence and representations;

  • And whereas that period has now expired:

  • Now therefore the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on the Secretary of State by section 17 of the Act hereby make the following Regulations in the terms of the said draft:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (National Curriculum) (Exceptions in History and Geography at Key Stage 4) Regulations 1992 and shall come into force on 1st August 1992.

(2) In these Regulations—

“the Act” means the Education Reform Act 1988; a reference to the provisions of the National Curriculum in history or geography is to such attainment targets, programmes of study and assessment arrangements as are specified for the time being for the subject in relation to the fourth key stage by orders made under section 4(2) of the Act; and a reference to the fourth key stage is to the period set out in paragraph (d) of section 3(3) of the Act. Exceptions to the provisions of the National Curriculum

2.  The provisions of the National Curriculum in history shall not apply—

(a)in the case of a pupil in the fourth key stage at a maintained school in England who is being taught the programme of study in geography set out in the document published by Her Majesty’s Stationery Office entitled “Geography in the National Curriculum (England)”(2) and specified in relation to that key stage by the Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (England) (No2) Order 1991(3); or

(b)in the case of a pupil in the fourth key stage at a maintained school in Wales who is being taught the programme of study set out in the document published by Her Majesty’s Stationery Office entitled “Geography in the National Curriculum (Wales)”(4) and specified in relation to that key stage by the Education (National Curriculum) (Attainment Targets and Programmes of Study in Geography) (Wales) Order 1991(5).

3.  The provisions of the National Curriculum in geography shall not apply—

(a)in the case of a pupil in the fourth key stage at a maintained school in England who is being taught the programme of study in history referred to as Model 2 in and specified in relation to the fourth key stage by the Education (National Curriculum) (Attainment Targets and Programmes of Study in History) (England) Order 1991(6); or

(b)in the case of a pupil in the fourth key stage at a maintained school in Wales who is being taught the programme of study in history referred to as Model B in and specified in relation to that key stage by the Education (National Curriculum) (Attainment Targets and Programmes of Study in History) (Wales) Order 1991(7).

Explanatory Note

(This note is not part of the Order)

These Regulations provide that the National Curriculum in history does not apply toa pupil in key stage 4 who is following the full programme of study in geography. Corresponding provision is made for the National Curriculum in geography. The effect of the regulations is thus that a pupil in key stage 4 who follows the full programme of study in one subject is not required to study the other.

  • Full and short programmes of study are specified for history and geography by the orders referred to in regulations 2 and 3.
