The Secretary of State for Social Security, in exercise of the powers conferred by section 166(1)to (3) of, and Schedule 20 to, the Social Security Act 1975(1) and section 24(1)(a) of the Social Security Pensions Act 1975(2) and all other powers enabling him in that behalf, and after agreement by the Social Security Advisory Committee that proposals to make these Regulations should not be referred to it(3), hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Social Security (Graduated Retirement Benefit) Amendment Regulations 1991 and shall come into force on 24th December 1991.

Amendment of Regulations

2.  At the end of regulation 2 of the Social Security (Graduated Retirement Benefit) (No. 2) Regulations 1978(4), there shall be added the words “as if that amount and those increases were included in the sums mentioned in subsections (1) and (3) of the said section 63 and graduated retirement benefit were a relevant benefit within the definition of “relevant benefit” in subsection (6) of the said section 64.”

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend regulation 2 of the Social Security (Graduated Retirement Benefit) (No. 2) Regulations 1978 (S.I. 1978/393) which applies sections 63and 64 of the Social Security Act 1986 (c. 50) to graduated retirement benefit. Section 63 makes provision for the up-rating of social security benefits and section 64 sets out what is the effect of an alteration of rates of benefit. The amendment in regulation 2 of these Regulations sets out how sections 63 and 64 are to apply to graduated retirement benefit.

1975 c. 14. Section 166(1) to (3)in specified exceptions, the Social Security Pensions Act 1975 shall have effect as if its provisions were contained in the Social Security Act 1975. Schedule 20 is cited for the definition of certain specified exceptions, the Social Security Pensions Act 1975 shall have effect as if its provisions were contained in the Social Security Act 1975. Schedule 20 is cited for the definition of regulations
