The Secretary of State for Health, in exercise of powers conferredby sections 13 and 18(1) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf,hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Special Hospitals ServiceAuthority (Functions and Membership) Amendment Regulations 1991 andshall come into force on 15th May 1991.

(2) In these Regulations,“the principal Regulations” means the Special Hospitals Service Authority (Functions andMembership) Regulations 1989(2).

Amendment of regulation 2 of the principal Regulations

2.  In regulation 2 of the principal Regulations (functions of theAuthority)(3)

, after paragraph (4) there shall be added the followingparagraph—

(5) In exercise of the Secretary of State’s functions specified inthe Schedule to these Regulations under section 25 of the Act, suchcharges shall be made with respect to the supplies of human blood as aredetermined by the Secretary of State..

Amendment of Schedule to the principal Regulations

3.  In columns (1) and (2) of the Schedule to the principal Regulations(provisions of the National Health Service Act 1977 conferring functionsexercisable by the Authority)(4), in the appropriate places in the numerical order of the sections listed in column (1) of that Schedule there shall be inserted theentries listed in columns (1) and (2) respectively of the Schedule tothese Regulations.

SCHEDULEPROVISIONS OF THE NATIONAL HEALTH SERVICE ACT 1977 FOR INSERTION INTO THE SCHEDULE TO THE PRINCIPAL REGULATIONS

Section 5(1)(b)Arranging for the giving of advice on contraception, for the medical examination of persons seeking such advice, for the treatment of such persons and for the supply of contraceptive substances and appliances.
Section 5(2)(d)Conducting or assisting, by grants or otherwise, persons to conduct research into matters relating to illness or other matters connected with a service provided under the Act.
Section 25 other than paragraphs (b) and (c)Making available supplies of human blood.
Section 51Making available facilities for university clinical teaching and research.
Section 52Making accommodation available.
Section 63(5)Authorising use of hospital accommodation, determining the extent to which it is to be made available and determining and recovering charges in respect of the use of such accommodation.
Section 72(1), (3), (4) and (5)Making available health service accommodation or facilities for the purpose of providing medical, dental, pharmaceutical, ophthalmic or chiropody services to non-resident private patients.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Special Hospitals ServiceAuthority (Functions and Membership) Regulations 1989 (“the principal Regulations”). They add further functions of the Secretary of State under theNational Health Service Act 1977 relating to special hospitals to thelist of those which the Special Hospitals Service Authority has beendirected to perform on his behalf under the principal Regulations.
