Explanatory Note

(This note is not part of the Order)

This Order makes provision for the transfer of property, rights and liabilities of the Inner London Education Authority (“ILEA”) on its abolition by the Education Reform Act 1988 (“the Act”) on 1st April 1990 (“the abolition date”).

By virtue of section 180 of the Act, where provision is not made for the vesting of any property, rights and liabilities of the ILEA, such property, etc. will vest on the abolition date in the London Residuary Body.

The Order makes provision for the general transfer of land held by the ILEA for the purposes of its functions to the inner London council in whose area the land is situated (article 3). The land specified in Schedules 2 to 13 is transferred to the inner London councils so specified, subject in some cases to one or more of the conditions in article 2 (article 4). Where land is transferred any ILEA property on the land is also transferred (article 5).

Various rights and liabilities (statutory and otherwise) and records of the ILEA are transferred (articles 7 and 9). Provision is made for the granting of easements where the Order vests parts of land in different bodies (article 10) and for the resolution of disputes (article 11).

County Hall and Jubilee Gardens, and land held for investment or which the ILEA had agreed or decided to dispose of, are excluded from the scope of the Order (articles 3 and 8). The provisions of the Order are subject to those of any other order transferring property under the Act.
