REGISTRATION OF BIRTHS, DEATHS, MARRIAGES, ETC. ENGLAND AND WALES

The Registrar General, in exercise of the powers conferred by sections 5, 9(5), 10(1), 10A(1), 39 and 41 of the Births and Deaths Registration Act 1953(1), sections 20(a) and 21(1) of the Registration Service Act 1953(2), as such powers are extended by section 2(2) of the Welsh Language Act 1967(3) and of all other powers enabling her in that behalf, with the approval of the Secretary of State for Wales(4), hereby makes the following Regulations –

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Registration of Births and Deaths (Welsh Language) (Amendment) Regulations 1989 and shall come into force on 1st April 1989.

(2) In these Regulations “the principal Regulations” means the Registration of Births and Deaths (Welsh Language) Regulations 1987(5), and unless the context otherwise requires any reference to a numbered regulation or Schedule is a reference to the regulation or Schedule bearing that number in the principal Regulations.

Substitution of forms 2 and 6 in Schedule 2

2.  For forms 2 and 6 in Schedule 2 there shall be substituted respectively the forms 2 and 6 in the Schedule to these Regulations.

Amendment of Schedule 3

3.  In Schedule 3 –

(a)in the entry relating to Regulation 10(b)(ii), after “Reg.10(b)(ii)” in column (1) there shall be added “and (iii)”;

(b)in the entry relating to Regulation 10(b)(iii) –

(i)for “(iii)” in column (1), there shall be substituted “(iv)”,

(ii)for “10(c)” in columns (2) and (3) there shall be substituted “10(1)(d)”;

(c)in the entry relating to Regulation 13(4)(b)(ii), for “10(c)” in columns (2) and (3) there shall be substituted “10(1)(d)”;

(d)in the entry relating to Regulation 17(2)(b)(i), after “Reg. 17(2)(b)(i)” in column (1) there shall be added “and (ii)”;

(e)in the entry relating to Regulation 17(2)(b)(ii) –

(i)for “(ii)” in column (1) there shall be substituted “(iii)”, and

(ii)for “10A(1)(c)” in columns (2) and (3) there shall be substituted “10A(1)(d)”;

(f)in the entry relating to Regulation 17(4)(b)(ii), for “10A(1)(c)” in columns (2) and (3) there shall be substituted “10A(1)(d)”.

FORM 6STATEMENT BY PARENTS FOR THE RE-REGISTRATION FOR THE RE-REGISTRATION OF A BIRTH

Explanatory Note

(This note is not part of the Regulations)

These Regulations make minor amendments to the Welsh versions of the forms and forms of words prescribed in connection with the registration and re-registration of births. The amendments are consequential on the coming into force of sections 24 and 25 of the Family Law Reform Act 1987.

1953 c. 20; section 5 was amended by the Children Act 1975 (c. 72), Schedule 3, paragraph 13(1) and further amended by the Registration of Births, Deaths and Marriages (Fees) Order 1968 (S.I. 1968/1242), Schedule 2; section 9(5) was added by the Children Act 1975(c. 72), section 93(3); sections 10 and 10A were substituted by the Family Law Reform Act 1987 (c. 42), sections 24 and 25 respectively;see the definitions of “the Minister” and “prescribed” in section 41.

1953 c. 37;see the definitions of “the Minister” and “prescribed” in section 21(1).

See the Secretary of State for Social Services Order 1968 (S.I. 1968/1699), article 2, which transferred all the functions of the Minister of Health to the Secretary of State; the approval of the Secretary of State is required by virtue of section 39 of the Births and Deaths Registration Act 1953 and by virtue of section 20 of the Registration Service Act 1953.
