1.  These Regulations may be cited as the Air Navigation (Restriction of Flying) (High Security Prisons) Regulations 1989 and shall come into force on 11th January 1990.

2.—(1) This regulation applies to each of the high security prisons specified in column 1 of the Schedule hereto, each of which for the purpose of this regulation shall be taken to comprise an area bounded by a circle of the radius specified in column 2 of the said Schedule opposite its name centred on the position so specified in column 3 of the said Schedule.

(2) A helicopter shall not fly over a high security prison to which this regulation applies below such height above mean sea level as is specified in column 4 of the said Schedule opposite its name:Provided that nothing in this regulation shall prohibit:

(a)in relation to the high security prisons at Albany and Parkhurst, flight for the purpose of landing at or taking off from the helicopter landing area at St Mary’s Hospital, Newport with the permission of the person in charge of St Mary’s Hospital, Newport and in accordance with any conditions to which that permission is subject; or

(b)flight by any helicopter operated by or on behalf of a police force for any area of the United Kingdom.
