In exercise of the powers conferred by sections 218(1)(a), (2), (3) and (6) and 232(5) of the Education Reform Act 1988(1), the Secretary of State for Education and Science hereby makes the following Regulations:

1.  These regulations may be cited as the Education (Teachers) (Amendment) (No. 2) Regulations 1989 and shall come into force on 31st August 1989.

2.  The Education (Teachers) Regulations 1989(2) shall be amended as follows–

(a)For paragraph 2 of Schedule 1 there shall be substituted the following paragraph–

2.  Any prohibition or restriction on a person’s employment in force immediately before 1st September 1989 which–

(a)is contained in a direction under regulation 10 of the 1982 Regulations, or

(b)has effect, by virtue of paragraph 2 of Schedule 2 to those Regulations, as if so contained

shall have effect as if it were contained in a direction under regulation 10(2) of these Regulations and, accordingly, regulation 10(6) shall apply in relation thereto.

(b)In paragraph 5(3)(a)(ii) of Schedule 4 after the words “in more than one school” there shall be added the words “maintained by the same local education authority”.

(c)In paragraph 1(1) of Schedule 5 the word “if” shall be deleted where it first appears and inserted at the beginning of sub-paragraph (a).

(d)The last sentence of paragraph 2(3) of Schedule 5 shall be deleted.

Explanatory Note

(This note is not part of the Regulations)

These amending Regulations make 4 corrections to the Education (Teachers) Regulations 1989. Paragraph 2 of Schedule 1 is amended so that it does not re-impose a bar on the employment of a teacher imposed before 8th April 1982 but subsequently withdrawn. Paragraph 5(3)(a)(ii) of Schedule 4 is amended by the addition to the statement required under paragraph 5(3)(a) of a requirement to state that the schools at which the teacher may be employed are maintained by the same local education authority. A drafting amendment has been made to paragraph 1(1) of Schedule 5. The final sentence of paragraph 2(3) of Schedule 5 has been deleted as inconsistent with the requirement for written notification of qualified teacher status under paragraph 1(1)(b) of that Schedule.
