In exercise of the powers conferred on the Secretary of State by section 10 of the Education Act 1944(1), the Secretary of State for Education and Science, as respects England, and the Secretary of State for Wales, as respects Wales, hereby make the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Education (School Premises) (Amendment) Regulations 1989 and shall come into force on 1st September 1989.

Amendment of the Education (School Premises) Regulations 1981

2.—(1) (a) In the definition of “school” in regulation 3(1) of the Education (School Premises) Regulations 1981(2), for the words ““school” means a school maintained by a local education authority” there shall be substituted the words ““school” means a grant-maintained school or a school maintained by a local education authority”.

(b)In the definition of “new school buildings” in that paragraph, after the words “section 14(1) of the Education Act 1980” there shall be inserted the words “or section 90(1) of the Education Reform Act 1988”(3).

(2) In regulation 3(3) of those Regulations, after sub-paragraph (b) there shall be inserted the following sub-paragraph –

(c)in the case of a grant-maintained school, by the governing body of the school.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Education (School Premises) Regulations 1981 to apply them to grant-maintained schools.

1944 c. 31. Section 10 was amended by paragraph 1 of Schedule 12 to the Education Reform Act 1988 (c. 40). For the transfer of functions to the Secretary of State see S.I. 1964/490, 1970/1536 and 1978/274.
