The Water Act 1989 (Commencement No. 1) Order 1989

The Secretary of State for the Environment, and the Secretary of State for Wales, acting jointly in exercise of the powers conferred on them by section 194(4) of the Water Act 1989(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Water Act 1989 (Commencement No. 1) Order 1989.

(2) In this Order, except where the context otherwise requires, references to sections and Schedules are references to sections and Schedules of the Water Act 1989.

Provisions coming into force on 7th July 1989

2.  Except insofar as they are already in force in accordance with section 194(2), the provisions specified in Schedule 1 to this Order shall come into force in England and Wales on 7th July 1989.

Provisions coming into force on 1st September 1989 or, if later, the transfer date

3.  Except insofar as they are already in force in accordance with section 194(2), the provisions specified in Schedule 2 to this Order shall come into force in England and Wales on 1st September 1989 or, if later, the transfer date.

Provision coming into force on 1st April 1990

4.  Subsection (2) of section 79 shall come into force on 1st April 1990.

Explanatory Note

(This note is not part of the Order)

This Order brings into force in three stages in England and Wales the provisions of the Water Act 1989, other than sections 98 to 100 (provisions relating to statutory water companies), Part II of Schedule 27 (repeals not coming into force on the transfer date) and that part of section 190 which relates to that Part, which are not brought into force directly by section 194(2) or (3) of the Act.

Schedule 1 specifies the provisions coming into force on 7th July 1989 and Schedule 2 specifies the provisions coming into force on 1st September 1989 or, if later, the transfer date (the day appointed under section 4 of the Water Act 1989 as the day on which functions are vested in the National Rivers Authority and the successor companies). Section 79(2) of the 1989 Act (which entitles water and sewerage undertakers to fix, demand and recover connection charges) is brought into force on 1st April 1990 by article 4 of the Order.
