8. [Withdrawal of reference] A party (including a person made a party to the proceedings under rule 7) may at any time before the Comptroller’s decision withdraw from the proceedings by serving a notice to that effect on the Comptroller and every other party to the proceedings, but such withdrawal shall be without prejudice to the Comptroller’s power to make an order as to the payment of costs incurred up to the time of service of the notice.
