The Queen’s Most Excellent Majesty in Council

Whereas the Government of Canada, in a declaration a copy whereof is set out in the Schedule to this Order, has designated the Yukon Territory as a province or territory of Canada to which the Convention between the United Kingdom of Great Britain and Northern Ireland and Canada providing for the Reciprocal Recognition and Enforcement of Judgments in Civil and Commercial Matters(1) shall extend;

And whereas it is expedient to specify that the courts of the Yukon Territory are recognised courts for the purposes of Part I of the Foreign Judgments (Reciprocal Enforcement) Act 1933(2).

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1 of the said Act and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order shall come into force on 1st January 1988 and may be cited as the Reciprocal Enforcement of Foreign Judgments (Canada) (Amendment) Order 1987.

2.  The Reciprocal Enforcement of Foreign Judgments (Canada) Order 1987(3) shall be amended by adding at the end of article 3 (which names the Canadian courts, including the courts of Provinces, which are to be recognised courts for the purposes of Part I of the Foreign Judgments (Reciprocal Enforcement) Act 1933) the words “or the Yukon Territory”.

SCHEDULECanadian declaration extending to the Yukon Territory the Convention between Canada and the United Kingdom of Great Britain and Northern Ireland Providing for the Reciprocal Recognition and Enforcement of Judgments in Civil and Commercial Matters

Pursuant to Article XII, the Government of Canada declares that in addition to the provinces of British Columbia, Manitoba, New Brunswick, Nova Scotia and Ontario, the Convention shall extend to the Yukon Territory. An application in the Yukon Territory for the registration of a judgment given by a court of the United Kingdom may be made in the Supreme Court of the Yukon Territory.

SCHEDULEDéclaration canadienne étendant au Territoire du Yukon l'application de la Convention entre le Canada et le Royaume-Uni de Grande-Bretagne et d'Irlande du Nord pour assurer la reconnaissance et l'execution réciproque des jugements en matière civile et commerciale

Conformément à l'article XII, le Canada déclare que la Convention qui s'applique déjà aux provinces de la Colombie-Britannique, du Manitoba, du Nouveau-Brunswick, de la Nouvelle-Ecosse et de l'Ontario, est étendue au Territoire du Yukon. Une demande peut être soumise dans le Territoire du Yukon en vue de l'enregistrement d'un jugement rendu par un tribunal du Royaume-Uni auprès de la Cour suprême du Territoire du Yukon.

This Order amends article 3 of the Reciprocal Enforcement of Foreign Judgments (Canada) Order 1987 so as to include the courts of the Yukon Territory as recognized courts.
