The Secretary of State, in exercise of the powers conferred by section 11(4) and (8) of the Clean Air Act 1956 and now vested in him(1), and of all other powers enabling him in that behalf, being satisfied that fireplaces of the classes described in the Schedule hereto can be used for burning fuel other than authorised fuels without producing any smoke or a substantial quantity of smoke, hereby makes the following order:—

Title, commencement and extent

1.—(1) This order may be cited as the Smoke Control Areas (Exempted Fireplaces) (Amendment) Order 1985 and shall come into operation on 9th July 1985.

(2) This order shall extend to England and Wales.

Amendment of the Smoke Control Areas (Exempted Fireplaces) Order 1984

2.  The Schedule to the Smoke Control Areas (Exempted Fireplaces) Order 1984 shall be amended:—

(a)by substituting “List No. 1048/June '83 8402” for “List No. 1084/June '83 8402”, and

(b)by adding the classes of fireplace and the manufacturers' instructions mentioned in the Schedule hereto.

The SE60 Coalburner Stove manufactured by Jetmaster Fires Limited

(a) installation instructions: reference “SE60/1 8/84”;

(b) operating and maintenance instructions: reference “SE60/2 8/84”.

The Worcester Centair 40 Solid Fuel Warm Air Heater manufactured by Worcester Engineering Co. Limitedoperating instructions and installation and maintenance instructions: reference “BC40.1.1. July 1982”.

EXPLANATORY NOTE

Section 11 of the Clean Air Act 1956 empowers local authorities to declare the whole or any part of their district to be a smoke control area in which the emission of smoke is generally prohibited. Specified classes of fireplaces may be exempted from control by order.

This order, which applies to England and Wales, amends the Smoke Control (Exempted Fireplaces) Order 1984 to exempt the SE60 Coalburner Stove fireplace manufactured by Jetmaster Fires Limited and the Worcester Centair 40 fireplace manufactured by Worcester Engineering Co. Limited subject to conditions as to installation, maintenance and operation.
