The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972 in relation to the common agricultural policy of the European Economic Community, acting jointly, in exercise of the powers conferred upon them by the said section 2(2), and of all other powers enabling them in that behalf, hereby make the following regulations, of which a draft has been approved by resolution of each House of Parliament:—
1. These regulations may be cited as the Agricultural Products Processing and Marketing (Improvement Grant) (Amendment) Regulations 1985 and shall come into operation on the day after the day on which they are made.
2. The Agricultural Products Processing and Marketing (Improvement Grant) Regulations 1977(2) shall be further amended by substituting in regulation 2(1) thereof for the definition of “the Council Regulation”, the following definition:—

These regulations further amend the Agricultural Products Processing and Marketing (Improvement Grant) Regulations, 1977 (the principal regulations) by substituting a new definition of “the Council Regulation” in regulation 2(1) thereof so as to incorporate a reference to the current Community instrument: Council Regulation (EEC) No. 1932/84 amending Council Regulation (EEC) No. 355/77 as regards common measures to improve the conditions under which agricultural products are to be processed and marketed.
Regulation (EEC) No. 355/77 empowers the Commission (subject, in specified circumstances, to the decision of the Council) to grant to projects aid from the European Agricultural Guidance and Guarantee Fund conditional upon financial contribution by the member state of the territory on which the projects are to be carried out. The principal regulations empower Ministers to make grants so as to qualify projects for aid under Regulation (EEC) No. 355/77.
Regulation (EEC) No. 1932/84 extends the duration of Regulation (EEC) No. 355/77 to 31 December 1994 and gives the Commission power to extend aid to products not listed in Annex II to the EEC Treaty; it widens the scope of Regulation (EEC) No. 355/77 so as to include aid for projects designed to introduce new techniques, recycling projects, and, subject to restrictions, the purchase of harvesting equipment.
The effect of the amendment is to apply the provisions of the principal regulations to projects eligible under Regulation (EEC) No. 355/77 as extended in scope and time by Regulation (EEC) No. 1932/84.
The Agricultural Products Processing and Marketing (Improvement Grant) (Amendment) Regulations 1983 are revoked.
