The Secretary of State for Transport, in exercise of the powers conferred by section 63(1) of the Road Traffic Act 1972(1) and now vested in him(2), and of all other enabling powers, and after consultation with representative organisations in accordance with the provisions of section 199(2) of that Act, hereby makes the following Regulations:—

1.  These Regulations shall come into operation on 2nd March 1985 and may be cited as the Motor Vehicles (Designation of Approval Marks) (Amendment) Regulations 1985.

2.  The Motor Vehicles (Designation of Approval Marks) Regulations 1979(3) shall be amended so as to have effect in accordance with the following provisions of these Regulations.

3.  In Schedule 2—

(a)after item 13C insert items 13D and 13E as specified in the Schedule to these Regulations;

(b)after item 31D insert items 31E to 31I as specified in the Schedule to these Regulations; and

(c)after item 50A insert item 54 as specified in the Schedule to these Regulations.

4.  In Schedule 3, in paragraph 6, for “31A and 31D” substitute “31A, 31D, 31E, 31F and 31I”.

EXPLANATORY NOTE

1. These Regulations further amend the Motor Vehicles (Designation of Approval Marks) Regulations 1979.

2. By virtue of these amendments (see Regulation 3):—

(a) new markings relating to motor vehicles approved in respect of their brakes are prescribed (by adding items 13D and 13E to Schedule 2) in consequence of amendments dated 26th November 1984 to ECE Regulation 13;

(b) new markings relating to halogen sealed beam headlamps are prescribed (by adding items 31E to 31I to Schedule 2) in consequence of amendments dated 7th February 1983 to ECE Regulation 31; and

(c) a new marking relating to pneumatic tyres for commercial vehicles and their trailers is prescribed (by adding item 54 to Schedule 2) in consequence of ECE Regulation 54 dated 1st March 1983.

3. As a result of the amendment mentioned at (b) above, Schedule 3 (which deals with requirements and permitted variations) is amended (see Regulation 4).

4. Copies of ECE Regulations may be obtained from Her Majesty's Stationery Office.
