The Housing Act 1980 (Commencement No. 1) Order 1980

17th September 1980

The Secretary of State, in exercise of the powers conferred on him by section 153(4) and section 151(1) of the Housing Act 1980 and of all other powers enabling him in that behalf, hereby makes the following order:—

1.  This order may be cited as the Housing Act 1980 (Commencement No. 1) Order 1980.

2.  Section 121 of the Housing Act 1980 shall come into operation on 1st October 1980.

3.  The provisions of the Housing Act 1980 specified in the Schedule to this order shall come into operation on 3rd October 1980.

1.  Parts III and IV.

2.  Sections 110, 111 and 114.

3.  Section 116(1) in so far as it relates to paragraph 6(1) and (2) of Schedule 14 and section 116(2).

4.  Sections 128, 129, 132 and 136.

5.  Section 141 except in relation to paragraph 7 of Schedule 21.

6.  Sections 143 to 146.

7.  Section 148.

EXPLANATORY NOTE

This Order brings into operation on 1st October 1980 section 121 of the Housing Act 1980, which relates to grants to and by the Housing Corporation.

It brings into operation on 3rd October 1980, the following provisions of the Housing Act 1980, together with associated and other minor and consequential amendments and repeals:—

1.  Parts III and IV which relate to tenants' repairs and improvements and matters of jurisdiction and procedure.

2.  Sections 110, 111, 114, part of 116(1), 116(2) and part of paragraph 6 of Schedule 14, which relate to mortgages and home ownership.

3.  Sections 128, 129 and 132, which relate to registered housing associations.

4.  Section 136 and Schedule 19, which relate to service charges.

5.  Section 141 and Schedule 21, apart from paragraph 7, which amend the Leasehold Reform Act 1967 and Schedule 8 to the Housing Act 1974.

6.  Section 143, which amends the Landlord and Tenant Act 1927 (c.36) in relation to the apportionment of rents and section 144, which provides for increased penalties for certain offences under the Housing Act 1974.

7.  Sections 145, 146, and Schedule 23, which relate to houses in multiple occupation.

8.  Section 148, which provides for the payment of pensions for presidents and vice-presidents of rent assessment panels.
