The European Communities (Definition of Treaties) Order 1974

The Queen's Most Excellent Majesty in Council

Whereas a draft of this Order has been laid before Parliament in accordance with section 1 of the European Communities Act 1972 and has been approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, by virtue and in exercise of the powers conferred on Her by section 1(3) of the European Communities Act 1972 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.  This Order may be cited as the European Communities (Definition of Treaties) Order 1974. It shall come into operation in respect of each treaty specified in Part I of the Schedule to this Order on the date on which the Order is made. In respect of each treaty specified in Part II of the Schedule to this Order, the Order shall come into operation on the date on which the treaty enters into force for the United Kingdom, which date will be notified in the London, Edinburgh and Belfast Gazettes.

2.  The Interpretation Act 1889 shall apply for the interpretation of this Order as it applies for the interpretation of an Act of Parliament.

3.  The treaties specified in the Schedule to this Order are to be regarded as Community Treaties as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE

PART I

1.  Decision of 10 December 1973 of the Representatives of the Governments of the Member States of the European Coal and Steel Community, meeting within the Council, opening tariff preferences for products covered by that Community and originating in Finland (OJ No. L 352, 21.12.73, p. 192).

2.  Decision of 18 December 1973 of the Representatives of the Governments of the Member States of the European Coal and Steel Community, meeting in Council, opening tariff preferences for certain steel products originating in developing countries (OJ No. L 358, 28.12.73, p. 192).

3.  Decision of 18 December 1973 of the Representatives of the Governments of the Member States of the European Coal and Steel Community, meeting in Council, opening, allocating and providing for the administration of tariff quotas for certain steel products originating in developing countries (OJ No. L 358, 28.12.73, p. 186).

4.  Protocol for the extension of the Food Aid Convention 1971, to which the United Kingdom acceded on 17 June 1974 (Cmnd. 5624).

PART II

5.  Protocol for the extension of the Wheat Trade Convention 1971, signed by the United Kingdom on 22 April 1974 (Cmnd. 5624).

EXPLANATORY NOTE

This Order declares the treaties mentioned in the Schedule to be Community Treaties as defined in section 1(2) of the European Communities Act 1972.
