In exercise of the powers conferred on me by section 73(2) and (3) of the Children and Young Persons Act 1969, I hereby make the following Order:—

Citation

1.  This Order may be cited as the Children and Young Persons Act 1969 (Commencement No.2) Order 1969.

Interpretation and extent

2.—(1) In this Order “the Act” means the Children and Young Persons Act 1969.

(2) Nothing in this Order shall bring into force, in their application to Scotland, any provisions of paragraph 54 of Schedule 5 to the Act and, accordingly, the references to the said provisions in Schedule 1 to this Order shall not include references thereto in their application to Scotland.

Days appointed for coming into force of certain provisions of the Act

3.  The provisions of the Act specified in column 1 of each of the first two Schedules to this Order (which relate to the matters specified in column 2 thereof) shall, subject to Article 2(2) of this Order, come into force on the day specified in the heading to that Schedule.

Transitional provisions

4.  The transitional provisions contained in Schedule 3 to this Order shall have effect in connection with the provisions brought into force by this Order which are referred to in that Schedule.

SCHEDULE 3TRANSITIONAL MODIFICATIONS OF PARAGRAPHS 20 AND 37 OF SCHEDULE 5 TO THE ACT

So long as section 15 of the Children Act 1948 continues to apply to a local authority by virtue of paragraph 13 of Schedule 4 to the Act then, in relation to that authority, paragraphs 20 and 37 of Schedule 5 to the Act shall have effect as if they provided that section 51 of the said Act of 1948, as amended by the said paragraph 20, and section 9 of the Mental Health Act 1959, as amended by the said paragraph 37, should have effect as if a home provided by the local authority under the said section 15 were a community home so provided under the Act.

EXPLANATORY NOTE

This Order brings certain provisions of the Children and Young Persons Act 1969 into force (subject, in the case of two provisions, to transitional modifications contained in Schedule 3 to the Order).

The provisions specified in Schedule 1 to the Order are brought into force on 1st December 1969 and those specified in Schedule 2 on 1st January 1970.
