The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to measures relating tobacco, tobacco products, nicotine, nicotine products and herbal products for smoking(2).

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 94 and 135(2) and (3) of the Children and Families Act 2014(3) and section 2(2) of the European Communities Act 1972.

A draft of these Regulations has been laid before and approved by resolution of each House of Parliament in accordance with section 135(6) of the Children and Families Act 2014 and paragraph 2(2) of Schedule 2 to the European Communities Act 1972(4).
