The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 78(2) and 104(1) of the Public Services Reform (Scotland) Act 2010(1), and all other powers enabling them to do so.

In accordance with section 104(2)(2) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  These Regulations may be cited as the Registration of Social Workers and Social Service Workers in Care Services (Scotland) Amendment Regulations 2017 and come into force on 2nd October 2017.

Amendment of the Registration of Social Workers and Social Service Workers in Care Services (Scotland) Regulations 2013

2.—(1) The Registration of Social Workers and Social Service Workers in Care Services (Scotland) Regulations 2013(3) are amended as follows.

(2) After regulation 5(7A) (requirements on social service workers) insert—

(7B) In the case of a social service worker of a description specified in column 1 of Table C in the Schedule who works in such a role on the date specified in column 2 of Table C in the Schedule—

(a)paragraph (1) does not apply until the date specified in the corresponding entry in column 3 of Table C in the Schedule;

(b)that worker must be registered by the date specified in column 3 of Table C in the Schedule; and

(c)paragraphs (2), (3), (5) and (6) do not apply..

(3) In the Schedule after Table B insert—

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Registration of Social Workers and Social Service Workers in Care Services (Scotland) Regulations 2013 (“the principal Regulations”) require social service workers to register with the Scottish Social Services Council in order to work in a care service. The principal Regulations contain transitional provisions which set a mandatory registration date for persons who are already employed when a new group of social service workers is required to register.

These Regulations amend the Schedule to the principal Regulations by inserting a new table (Table C) which specifies two additional descriptions of social service workers - support worker in a care at home service and support worker in a housing support service. These Regulations also set a mandatory registration date of 30th September 2020 for workers who work in either of these roles on 2nd October 2017.
