The Scottish Ministers make the following Order in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990(1) and all other powers enabling them to do so.
1.—(1) This Order may be cited as the Financial Assistance for Environmental Purposes (Scotland) Order 2009 and comes into force on 6th April 2009.
(2) This Order extends to Scotland only.
2. In section 153(1) of the Environmental Protection Act 1990(2) (financial assistance for environmental purposes), after paragraph (yy)(3), insert–
“(zz)the scheme known as the Community and Renewable Energy Scheme.”.

This Order varies section 153(1) of the Environmental Protection Act 1990 so as to enable the Scottish Ministers to give financial assistance to, or for the purposes of, the scheme known as the Community and Renewable Energy Scheme with effect from 6th April 2009.
1990 c. 43. The functions of the Secretary of State were transferred to the Scottish Ministers, in or as regards Scotland, by virtue of section 53 of the Scotland Act 1998 (c. 46).
