The Scottish Ministers make the following Order in exercise of the powers conferred by section 32(3) of the Police (Scotland) Act 1967(1) and all other powers enabling them to do so.

Citation and commencement

1.  This Order may be cited as the Police Grant (Variation) (Scotland) Order 2008 and shall come into force on 7th March 2008, but article 2 shall have effect from 1st April 2007.

Variation of the Police Grant (Scotland) Order 2007

2.  The Police Grant (Scotland) Order 2007(2) is amended as follows–

(a)in article 2 (aggregate amount of grants for financial year 2007–2008), for “£551,047,000” substitute “£551,380,710”; and

(b)in article 3 (amount of grant to an authority for financial year 2007–2008), for the table contained therein, substitute the following table–

Explanatory Note

(This note is not part of the Order)

This Order varies the Police Grant (Scotland) Order 2007 for the financial year 2007/08 to state the actual aggregate police grant and the amounts of police grant paid to each police authority and joint police board in respect of that financial year, as redetermined on the basis of audited accounts.

A redetermination of the police grant is carried out because the police grant as stated in the Police Grant (Scotland) Order 2007 was based on estimated budget figures. Upon receipt of audited accounts, the Scottish Ministers have substituted audited figures into the formula used to calculate the police grant and the amount of police grant has been redetermined accordingly.

A report on the considerations taken into account by the Scottish Ministers in making the redetermination has been prepared and laid before the Scottish Parliament in accordance with section 32(6) and (9) of the Police (Scotland) Act 1967.

1967 c. 77; section 32 was substituted by the Crime and Punishment (Scotland) Act 1997 (c. 48), section 45(1) and amended by the Scotland Act 1998 (Consequential Modifications) (No. 2) Order 1999 (S.I. 1999/1820), Schedule 2, paragraph 41(2). The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
