The Registrar General, in exercise of the powers conferred by sections 122(3) and 258(2) and (3) of the Civil Partnership Act 2004(1), and with the approval of the Scottish Ministers in accordance with section 126(3) of that Act, makes the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Registration of Civil Partnerships (Prescription of Forms, Publicisation and Errors) (Scotland) Amendment Regulations 2007 and shall come into force on 1st March 2007.

(2) These Regulations extend to Scotland only.

Form of the Register of Dissolutions of Civil Partnership – electronic copies

2.  In the Registration of Civil Partnerships (Prescription of Forms, Publicisation and Errors) (Scotland) Regulations 2005(2)–

(a)regulation 10 (form of the Register of Dissolutions of Civil Partnership) becomes paragraph (1); and

(b)after that paragraph, insert–

(2) Such extracts may be copies of extracts received in electronic form from the Court of Session or the sheriff court..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the arrangements for the form of the Register of Dissolutions of Civil Partnership held under section 122 of the Civil Partnership Act 2004. They provide that entries in that register held in the form of numbered extract Court of Session or sheriff court decrees may comprise copies of such extracts received in electronic form from the court.

A Regulatory Impact Assessment has not been produced for this instrument as it has no impact on costs to business.

2004 c. 33 (“the 2004 Act”). Sections 126(1) and 135 of the 2004 Act contain definitions of “prescribed” and “Registrar General” respectively relevant to the exercise of the statutory powers under which these Regulations are made.
