The Department of Agriculture, Environment and Rural Affairs make these regulations in exercise of the powers conferred by section 50 of, and paragraphs 1(1) and 2(2) of Schedule 4 to, the Environment Act 2021 (“the Act”)(1) and now vested in it(2).
The Department of Agriculture, Environment and Rural Affairs makes these Regulations after consultation in accordance with paragraph 8 of Schedule 4 to the Act and is satisfied as to the matters specified in paragraph 9(1) of that Schedule.
The Department of the Environment was dissolved by section 1(9) of the Departments Act (Northern Ireland) 2016 and, by virtue of Article 8(1)(c) of the Departments (Transfer of Functions) Order (Northern Ireland) 2016, its functions for the purposes of these Regulations were transferred to the Department of Agriculture, Environment and Rural Affairs
