The Department of Agriculture, Environment and Rural Affairs(1) with the approval of the Department of Finance(2), makes the following Scheme in exercise of the powers conferred by section 15(1) and (2) of the Fisheries Act 1981(3), as read with paragraph 2(1) of Schedule 2 of the Sea Fisheries (Northern Ireland) Order 2002(4), and now vested in it(5).
1. This Scheme may be cited as the Sea Fish Industry (Coronavirus) (Fixed Costs) (Amendment) Scheme (Northern Ireland) 2020 and comes into operation on 8 June 2020.
2.—(1) The Sea Fish Industry (Coronavirus) (Fixed Costs) Scheme (Northern Ireland) 2020(6) is amended as follows.
(2) In Article 2(2), in the definition of “length overall” for “Council Regulation (EEC) No 2930/86”(7) substitute “Regulation (EU) 2017/1130”(8).

This Scheme amends the definition of “length overall” in article 2 of the Sea Fish Industry (Coronavirus) (Fixed Costs) Scheme (Northern Ireland) 2020 to refer to the most recent EU legislation (EU) 2017/1130 that provides for the characteristics of fishing vessels.

The function of the Treasury to approve a Scheme under section 15 of the Fisheries Act 1981 is, by virtue of article 3(2) of, and paragraph 2(7)(a) of Schedule 2, to, the Sea Fisheries (Northern Ireland) Order 2002, exercisable by the Department of Finance where the Scheme is made by the Department of Agriculture, Environment and Rural Affairs.
