The Police Service of Northern Ireland (Amendment) Regulations 2020

The Department of Justice, in exercise of the powers conferred by sections 25(1) and 26(1) of the Police (Northern Ireland) Act 1998(1), makes the following Regulations. Those powers are now vested in the Department(2).

In accordance with sections 25(8) and 26(6) of that Act the Department has consulted the Northern Ireland Policing Board and the Police Association for Northern Ireland before making these Regulations.

Citation and commencement

1.  These Regulations may be cited as the Police Service of Northern Ireland (Amendment) Regulations 2020 and shall come into operation on 1st April 2020.

Amendment of the Police Service of Northern Ireland Regulations 2005

2.—(1) The Police Service of Northern Ireland Regulations 2005(3) shall be amended in accordance with paragraph (2).

(2) In regulation 3(1) in paragraph (a) of the definition of “public holiday”, for 2020 only, for the words “first Monday in May” substitute “Friday 8th May”.

Amendment of Police Service of Northern Ireland and Police Service of Northern Ireland Reserve (Injury Benefit) Regulations 2006

3.—(1) The Police Service of Northern Ireland and Police Service of Northern Ireland Reserve (Injury Benefit) Regulations 2006(4) shall be amended in accordance with paragraph (2).

(2) In Schedule 1 in paragraph (a) of the definition of “public holiday”, for 2020 only, for the words “first Monday in May” substitute “Friday 8th May”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Police Service of Northern Ireland Regulations 2005 and Police Service of Northern Ireland and Police Service of Northern Ireland Reserve (Injury Benefit) Regulations 2006 to allow for the public holiday on the first Monday in May to be replaced by Friday 8th May 2020 to mark the 75th anniversary of VE Day.

1998 c.32. Relevant amendments are made by section 78(1) of and paragraph 23 of Schedule 6 to the Police (Northern Ireland) Act 2000.

Article 5 of and paragraphs 9 and 10 of Schedule 3 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order (S.I. 2010/976) transferred the regulation making powers of the Secretary of State to the Department of Justice.
