The Department of Agriculture and Rural Development, being a Department designated (1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community and in relation to the promotion of rural development, in exercise of the powers conferred on it by the said section 2(2), hereby makes the following Regulations.
1. These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Amendment) Regulations (Northern Ireland) 2014 and shall come into operation on 1 April 2014.
2.—(1) The Interpretation Act (Northern Ireland) 1954 (3)shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly
(2) In these Regulations, “the principal Regulations” means the Common Agricultural Policy Single Payment and Support Schemes Regulations (Northern Ireland) 2010(4).
3. The Principal Regulations shall be amended as provided in regulation 4.
4. In regulation 7 (Transfers), substitute-
“Transfers
7. For the purposes of Article 12(3) of Commission Regulation 1120/2009 (5), a transferor of a payment entitlement must notify the transfer to the competent authority that allocated that entitlement by 2 May 2014.”.

These Regulations amend the Common Agricultural Policy Single Payment and Support Scheme Regulations (Northern Ireland) 2010 (“the principal Regulations”). The principal Regulations make provision in Northern Ireland for the administration of Council Regulations (EC) No. 73/2009 (O.J. L30, 31.01.2009, p 16), and other associated Community instruments in relation to direct support schemes under the Common Agricultural Policy.
These Regulations replace and substitute regulation 7 (Transfers) of the principal Regulations by removing provisions relating to the requirement for the transfer of payment entitlements within specified time limits and replacing them with the requirement for the transfer of payment entitlements to be communicated by the transferor by 2 May 2014.
